Terms and conditions

Who you are contracting with

ARAZ Scales is a trade name of ARAZ SCALES LLC, registered in the state of Texas. ARAZ SCALES LLC is the party you are contracting with, and these terms are governed by Texas law.

What each service covers

Landing page, $100 one time

One page, for a business that needs somewhere to send people rather than a whole site. The work covers:

• One page: what you do, the area you cover, and how to reach you
• Written for you. You do not have to write any of it
• A contact form that emails you when somebody fills it in
• Built for a phone first, which is where most of your customers will see it
• Set up so Google can read it, and pointed at your Google Business listing
• Your domain, your hosting account, your logins, all handed over at the end

How long. One week, counted from the day you send us your photos and details.

Not included. Online payments, booking systems and customer logins are not part of this. If you need more than one page, the $300 website is the one to buy.

Website, $300 one time

A five page website for a business that does not have one yet. The work covers:

• Five pages: home, services, about, contact, and one more if you need it
• Written for you. You do not have to write any of it
• A contact form that emails you when somebody fills it in
• Built for a phone first, which is where most of your customers will see it
• Set up so Google can read it, and pointed at your Google Business listing
• Your domain, your hosting account, your logins, all handed over at the end

How long. Two weeks, counted from the day you send us your photos and details.

Not included. Online payments, booking systems and customer logins are not part of this. If you need one, tell us and we will point you at someone who does them.

Content and ads, $500 a month

One monthly service covering the writing and the ad creative, for owners who already have a site.

Not included. The money you spend on ads is not part of the $500. Meta charges it to your card, in your own ad account. You set the budget and you can stop it at any time.

Written content and Meta ads (ad creative and campaign management) are one service at one price. They are not sold separately, so neither has a figure of its own. There is no setup fee.

When the retainer ends. On the last day of service, we pause every campaign we manage in your Meta ad account, unless you tell us in writing (email is fine) before that date that you want them left running. Either way, we remove our partner access within two business days after service ends and confirm by email. The campaigns, ads and results stay in your account. Nothing is deleted. Any ad spend after service ends is yours to manage.

Payment

• The landing page. $100 in total, paid in full before we start. There is no second payment and nothing is invoiced on launch day. This is not the same arrangement as the website below, so check which of the two you are buying.
• The website. $300 in total, split in two. Half is due before we start and half is due on the day the site goes live. We invoice by email and payment is due within seven days of the invoice.
• The monthly retainer. $500 a month, charged in advance on the same date each month. The first month is charged on the day we start.

We do not charge interest on late payment. If an invoice goes more than thirty days past due we will stop work and tell you why, and we will not hand over logins for unpaid work.

Prices are in US dollars and do not include any sales tax that may apply.

Revisions

On a website or a landing page. Two rounds of changes are included on either, before it goes live. A round means you send us one list of everything you want changed and we work through it. Sending three items on Monday and two more on Wednesday counts as two rounds, so it is worth collecting them up.

After the site is live, tell us what you need and we will quote it in writing before we do anything. If it is a small text change we will show you how to do it yourself on a call at no charge.

On content and ads. Nothing is published or handed over until you have approved it. Ask for as many changes as you like on each piece. What is fixed is the volume, which is eight posts a month and one round of new ad creative a month, not the number of edits.

What we need from you

Almost everything we are late on is something we are waiting for. You are responsible for supplying:

• Accurate details about the business: hours, service area, what you charge if you want it listed, and the licences or registrations you want shown.
• Photographs you own or have permission to use. If you send us a picture, you are telling us you have the right to publish it. We will not use images pulled from a search engine and we will not generate fake ones.
• Access to your domain and any existing accounts we need, or the authority to register them in your name.
• Answers within a reasonable time when we ask a question.
• Approval of anything published under your name, including posts and ad copy. You have the final read.

If we cannot get what we need for more than sixty days, we may close the job. The deposit stays with us, any balance is not charged, and we will not invoice you for anything beyond what you have already paid. That is the same position as any other cancellation and it is set out in full on the refund policy page.

Who owns the finished work

You do, once you have paid in full. That covers the website, its text, its layout, the posts we write for you and the ad creative we build. On the day the site goes live and the balance is paid, the domain is in your name, the hosting account is in your name, and every login is yours.

Two things stay ours. The first is the general know how and technique we use, which we obviously go on using for other clients. The second is any open source component in the site, which stays under its own licence, and those licences are recorded in the project.

We would like to show your site in our own portfolio and mention that we built it. If you would rather we did not, say so and we will not.

Cancelling

Refunds and notice periods are set out in full on the refund policy page. In short: a landing page is refundable in full until we start work and not after, because it is paid up front and there is no second payment to hold back. On a website the deposit covers work already begun and is not refundable, and the balance is not charged at all if you cancel before launch. The monthly retainer needs fourteen days notice.

What we promise, and what we do not

We promise the work will be done with reasonable care and skill, that the site will work on a current phone and desktop browser, and that we will fix anything broken that is our fault, free, for thirty days after launch.

We do not promise business results. Nobody honestly can. We cannot promise a particular position in Google, a number of phone calls, a cost per lead, or that any given ad will work. If somebody in this industry offers you a guaranteed ranking, that is a good reason to walk away from them.

We do not control the platforms. Google, Meta, your host and your domain registrar all change their rules and their prices without asking us, and any of them can suspend an account for reasons they do not explain. We will help you deal with it, but it is not something we can be held to.

Limits on liability

If we get something wrong and it costs you money, our total liability is capped at what you paid us for the work in question. For a landing page that is $100 and for a website $300. For the retainer it is the fees you paid us in the three months before the problem.

We are not liable for lost profit, lost business, lost data, or costs you incur with a third party, and neither of us is liable for a failure caused by something genuinely outside our control.

Nothing in these terms limits any liability that cannot be limited under Texas law, including under the Texas Deceptive Trade Practices Act.

Disagreements

Email us first. Almost everything is a misunderstanding that one phone call fixes, and we would rather fix it than argue about it. If that fails, these terms are governed by the law of the state of Texas and any dispute goes to the courts of Harris County, Texas.

If these terms change

The date at the top changes with them. The terms that apply to your job are the ones in force on the day we agreed the work, and we will not change them mid job without telling you.
